Affiliate Terms & Conditions

By signing up for the Dream Wild Studio Affiliate Program (Program), you indicate your acceptance of this Agreement and its terms and conditions.

Dream Wild Studio (“We”) will provide Affiliate with an affiliate link(s), commission(s), and collateral materials for the promotion of the Company’s product(s) and/or service(s).

We reserve the right to approve or reject ANY Affiliate Program Application at our sole and absolute discretion. You will have no legal recourse against us for the rejection of your Affiliate Program Application. 

Dream Wild Studio will provide Affiliate with compensation at a rate of 20% commission or otherwise specified in the Affiliate Dashboard. 

Dream Wild Studio will pay Affiliate in a reasonable manner, namely within 30 days after each sale is made.

You cannot refer yourself, and you will not receive a commission on your own accounts. 

Dream Wild Studio will pay Affiliate by Paypal and Affiliate must have their business Paypal account set up properly to do so. We reserve the right to invoice Affiliate in the event of a refund or successful chargeback attempt. Dream Wild Studio will make reasonable efforts to cooperate with the Affiliate in the event of a payment discrepancy or error in accounting.

INTELLECTUAL PROPERTY

You agree that the intellectual property owned by Dream Wild Studio includes all copyrights, trademarks, trade secrets, patents, and other intellectual property belonging to Dream Wild Studio. You may not modify the Dream Wild Studio Intelectual Property in any way and you are only permitted to use the Dream Wild Studio Intelectual Property if you are an Affiliate in good standing with us. We may revoke this license at any time and if we find that you are using Dream Wild Studio Intelectual Property in any manner not contemplated by this Agreement, we reserve the right to terminate this Agreement.

TERMINATION

Affiliate account can be terminated by either Party at any time with or without cause. You may only earn payouts as long as you are an Affiliate in good standing during the term. If you terminate this Agreement with us, you will qualify to receive payouts earned prior to the date of termination. In addition to the foregoing, Dream Wild Studio reserves the right to terminate any Affiliate account at any time, for any violations of this Agreement or for no reason. Your affiliate application and status in the Program may be suspended or terminated for any of the following reasons:

• Inappropriate advertisements (false claims, misleading hyperlinks, etc.).
• Spamming (mass email, mass newsgroup posting, etc.).
• Advertising on sites containing or promoting illegal activities.
• Failure to disclose the affiliate relationship for any promotion that qualifies as an endorsement under existing Federal Trade Commission guidelines and regulations, or any applicable state laws.
• Self-referrals, fraudulent transactions, suspected Affiliate fraud.

INDEPENDENT CONTRACTOR RELATIONSHIP

By signing up for the Affiliate Program, the Affiliate agrees to these Terms and becomes an independent contractor of the Dream Wild Studio. Affiliates and any related sub-contractors are not employees, partners, or members of Dream Wild Studio. Affiliate has the sole right to control and direct the means, manner, and method by which the Affiliate Services in this Agreement are performed. Parties are individually and separately responsible for their own business operation and expenses, including securing or paying any licensing fees, insurance, taxes (including FICA), registrations, or permits. Dream Wild Studio is not responsible for paying for any benefits, Workers’ Compensation, insurance, or unemployment fees to Affiliate.

SPECIFIC TERMS

We will determine whether the payout is permissible at our sole and exclusive discretion. We reserve the right to reject clicks and/or sales that do not comply with the terms of this Agreement. 

Qualified Purchases:

• Must not be referred by any other partner or affiliate links of Dream Wild Studio (Qualified Purchases are only available through your specific Affiliate Link)
• May not be purchased by an already-existing partner or affiliate of Dream Wild Studio
• May not be purchased prior to the Affiliate joining the Affiliate Program
• May only be purchased through a properly-tracking Affiliate Link
• May not be purchased by a customer in violation of any of our legal terms 
• May not have been induced by the Affiliate offering the customer any coupons or discounts

LIABILITY

Dream Wild Studio will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, or any results of intents of harm to the Affiliate Program and/or to our website(s). We do not make any expressed or implied warranties with respect to the Affiliate Program and/or the memberships or products sold by Dream Wild Studio. We make no claim that the operation of the Dream Wild Studio and/or our website(s) will be error-free and we will not be liable for any interruptions or errors.

NO WARRANTIES

You agree that your use of the Affiliate Program is at your sole and exclusive risk and that any services provided by us are on an “As Is” basis. Dream Wild Studio makes no warranties that the Affiliate Program will meet your needs or that it will be uninterrupted, error-free, or secure. Dream Wild Studio also makes no warranties as to the reliability or accuracy of any information. You agree that any damage that may occur to you, through your computer system, or as a result of the loss of your data from your use of the Affiliate Program is your sole responsibility and that Dream Wild Studio is not liable for any such damage or loss.

DATA LOSS

Dream Wild Studio does not accept responsibility for the security of your account or content. You agree that your participation in the Affiliate Program is at your own risk.

TERMS OF AGREEMENT

The term of this Agreement begins upon your acceptance of the Affiliate Program and will end when your Affiliate account is terminated.

The terms and conditions of this agreement may be modified by us at any time. If any modification to the terms and conditions of this Agreement is unacceptable to you, your only choice is to terminate your Affiliate account. Your continuing participation in the Affiliate Program will constitute your acceptance of any change.
